1. Agreement to Terms
By accessing or using BlitzIQ Pro™ ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Service Description
BlitzIQ Pro™ is a premium football analytics and game charting platform designed for elite coaching programs. The Service provides:
- Real-time game charting and play-by-play analysis
- AI-powered opponent scouting and tendency analysis
- Practice script generation and season management tools
- Advanced analytics including EPA and win probability calculations
- Multi-user team collaboration with role-based access control
3. Subscription and Billing
3.1 Subscription Plan
BlitzIQ Pro™ is offered as a subscription service at $249.00 USD per month. Each subscription includes access for up to 10 team members ("seats"). Additional seats may be purchased separately.
3.2 Billing Cycle
Subscriptions are billed monthly in advance. Your subscription will automatically renew each month unless canceled before the renewal date. All fees are non-refundable except as required by law.
3.3 Payment Method
You must provide a valid payment method to subscribe to the Service. By providing payment information, you authorize Trips Right, LLC to charge your payment method for all fees incurred. Payment processing is handled securely by Stripe, Inc.
3.4 Failed Payments
If a payment fails, we will attempt to process the payment again. If payment cannot be processed after multiple attempts, your subscription may be suspended or terminated, and you may lose access to the Service.
4. User Accounts and Team Management
4.1 Account Registration
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4.2 Account Security
You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
4.3 Team Seats
Each subscription includes 10 team member seats. The account owner (Head Coach) is responsible for managing team member access, roles, and permissions. Sharing login credentials is prohibited.
5. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Upload or transmit viruses, malware, or other malicious code
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers
- Use the Service for any illegal or unauthorized purpose
- Share your account credentials with unauthorized users
- Scrape, copy, or redistribute Service content without permission
6. Intellectual Property Rights
6.1 Service Ownership
The Service and its original content, features, and functionality are owned by Trips Right, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. BlitzIQ Pro™ is a trademark of Trips Right, LLC.
6.2 User Data
You retain all rights to the data you upload to the Service ("User Data"). By uploading User Data, you grant Trips Right, LLC a worldwide, non-exclusive, royalty-free license to use, store, and process your User Data solely for the purpose of providing and improving the Service.
7. Data Privacy and Security
Your use of the Service is also governed by our Privacy Policy. We implement industry-standard security measures to protect your data, including encryption, secure authentication, and regular security audits. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
8. Cancellation and Termination
8.1 Cancellation by You
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until the end of the paid period. No refunds will be provided for partial months.
8.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in fraudulent, abusive, or illegal activity. Upon termination, your right to use the Service will immediately cease.
8.3 Data Retention
Upon cancellation or termination, you may export your data within 30 days. After 30 days, we reserve the right to delete your data from our systems, except as required by law or for legitimate business purposes.
9. Disclaimers and Limitations of Liability
9.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPS RIGHT, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must cancel your subscription.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
